Cerner Online Privacy Notice for U.S. Applicants, Associates, and Independent Contractors

As a leading worldwide health care IT provider, Cerner holds itself to the highest standards of data privacy including notifying all applicants, associates (employees) and independent contractors of how we collect and utilize your data. This privacy notice is meant to provide you with the information on how Cerner may use your personal information in the course of Cerner business. This notice is intended to comply with applicable laws, such as the California Consumer Privacy Act. If any provision below conflicts with a legal requirement, then Cerner will comply with the applicable law.

Depending on your relationship with Cerner, we may collect personal information from you through several different avenues, including but not limited to, our website, your mobile device, email, physical locations, the mail, and/or the telephone. The type of data collected depends on your relationship with Cerner (applicant, associate, or contractor) and the particular business purpose (payroll, benefits, workforce management, etc.).

Personal information collected as a part of your job application, employment or contracted work (in the case of an independent contractor) is processed by or on behalf of Cerner in the United States as well as shared with other Cerner group companies on a need to know basis, e.g. if you apply for a job in a different country. Cerner has self-certified to the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield Framework.


Applicants:

If you decide to apply for an open position at Cerner, you will do so through our online application platform. For the purpose of the application process, we collect personal information from you in order to evaluate your application. Any such personal information will be provided by you voluntarily, although some is required to advance through the recruiting process. Please refer to the matrix below regarding how Cerner may use your data:

Contact information: such as your name, home and work address, personal and work telephone numbers, personal and work email addresses.

We use this information to open and maintain candidate records and communicate with you regarding your interest in a job opportunity with us, your application for employment, or updates on your candidacy.

Job-related information and qualifications: such as position applied for, previous job roles, education, awards, qualifications, certificates, licenses, financial relationships, compensation and salary information, and any other information you choose to provide in your resumes and/or applications.

We use this information to assess your suitability for a position at Cerner and conflict of interest reporting.

National identification information: such as if you are authorized to work. If you are working on a government contract, you may be asked if you are a U.S. Citizen.

We collect and use this information at the post-offer stage to determine your eligibility to work and fulfill our obligations to relevant government authorities.

Travel-related records: such as frequent flyer numbers, itineraries, flight, train, rental car, car service, hotel or other similar information.

We use this information to arrange or reimburse travel where you require travel to interview with us, contact you during travel, as necessary with travel service providers, or in an emergency situation.

Results of background checks and screening: such as education verification and criminal records and driver's license checks.

We use this to validate your suitability for certain job roles at the post-offer stage (to the extent permitted or required by law).

Demographic information: such as your ethnicity, religion, gender and sexual orientation.

We use this to conduct equal opportunity and diversity reporting where permitted or required by law.


If you accept a Cerner job offer, any personal information you provided during the application process will be transferred to our HR administration systems for Cerner associates, where you can access and request to amend such details. As a Cerner associate, the processing of your employee records will follow Cerner’s internal HR privacy policy. Where Cerner does not make you an offer, we delete your records when required by law.


Associates (Employees):

If you are hired as a Cerner associate, we collect personal information from you in the course of your employment. Any such personal information will be provided by you voluntarily, although some is required by applicable law for Cerner to employ you. Cerner may collect, use, and disclose your personal information for business purposes only and consistent with applicable law. Please refer to the matrix below regarding how Cerner may use your data:

We use this information to open and maintain your associate records, communicate with you for internal business purposes or emergencies, maintain an internal associate directory and grant you access to internal systems.

Job-related information and qualifications: such as position applied for, previous job roles, education, awards, qualifications, certificates, licenses, financial relationships, compensation and salary information, eligibility for and participation in benefit schemes and award programs, and any other information you choose to provide in your resumes and/or applications, as well as work anniversary information and skills and experience over the employment period.

We use this information to assess your personal and professional development, your suitability for promotions, benefits and other awards, job moves and staff restructuring, conflict of interest reporting, and to fulfill our obligations to regulators (including demonstrating the suitability of associates for their job).

National identification information: such as your country of birth or the country where you are a registered national or citizen, and any visa or other right to work.

We use this information to determine your eligibility to work and fulfill our obligations to relevant government authorities.

Age and benefits information: such as your date of birth, social security number, marital status, information about your pension and other welfare benefits.

We use this to maintain employment records and assess your eligibility for and/or pay you any statutory or other benefits to which you may be entitled.

Health and disability records: such as information relating to any disability or health condition that is relevant to your job, including the results of any pre- or post-employment physical or screening examination.

We use this information to address our legal obligations to you, make any adjustments required to assist you in the performance of your job and determine whether you are fit to undertake tasks required by your job.

Beneficiaries, dependents and emergency contact information: such as names, addresses, phone numbers, email addresses, or any other information about any beneficiaries, dependents, emergency contacts and next of kin.

We use this information to maintain your employment records and contact the designated contacts in the case of an emergency.

Financial Information: such as your bank account details.

We use this information to pay you or provide other benefits and process any expense claims.

Travel-related records: such as frequent flyer numbers, itineraries, flight, train, rental car, car service, hotel or other similar information.

We use this information to arrange or reimburse travel, contact you during travel, as necessary with travel service providers, or in an emergency situation.

Professional memberships: such as information about your membership in professional bodies and consultation bodies, including trade unions.

We use this to assess your personal and professional development and perform our legal obligations in relation to your professional or trade membership.

Results of background checks and screening: such as education verification, criminal records and driver’s license checks.

We use this to determine your suitability for certain job roles (to the extent permitted or required by law).

Salary and benefits information: such as salary details, bonus payments, retirement/pension details, medical insurance, equity/stock details.

We use this information to allocate resources and process payments of benefits, salary and any other amounts we owe you.

Performance and development records: such as training records, records of courses and training undertaken, performance reviews and assessments.

We use this information for career planning and skills monitoring, assessing your suitability for promotions, job moves, and staff restructuring, providing references for future applications and fulfill our obligations to regulators (including demonstrating the suitability of associates for their job to regulators and professional bodies).

Corrective action records: such as details of warnings and other records relating to conduct.

We use this information for assessing and taking action in relation to corrective action, disciplinary, capability, grievance and conduct issues, maintaining your employment records, monitoring and improving our human resources procedures and processing and fulfilling our obligations to regulators.

Absence records: such as records relating to time away

from the office, including vacation, illness and paternity/maternity leave.

We use this information to monitor absences and sickness, make decisions relating to human resource allocation, salary and benefit changes and address other issues that may arise from absences.

Health and safety records: such as occupational health records, information relating to health and safety in the workplace, accidents and near misses.

We use this to address our legal obligations to you in relation to health and safety in the workplace.

Information we obtain from monitoring: such as records of your use of our computer systems or the Internet, and recordings from surveillance cameras on our business premises.

We use this to monitor your compliance with our internal policies and procedures, to investigate security breaches and misuse of computer equipment and systems, to protect the safety of associates and third parties, and to protect our property from theft, vandalism and damage.

Demographic information: such as your ethnicity, religion, gender and sexual orientation.

We use this to conduct equal opportunity and diversity reporting where permitted or required by law.

Information regarding your phone or mobile device:such as your mobile phone number and mobile phone or device billing and usage records.

We use this, in accordance with applicable policies, to reimburse you for use of your mobile phone or device for employment-related purposes.

Biometric information: such as facial recognition, fingerprint or hand punch/hand-geometry data collected by a biometric time clock.

This is only used at the Kansas City-based Healthe Clinic locations for verification purposes.


Should your employment relationship with Cerner end, Cerner retains the records according to our record retention procedures and any applicable laws.


Independent Contractors:

We may collect and use the following personal information about you in relation to the services you provide to Cerner as an independent contractor. Please refer to the matrix below regarding how Cerner may use your data:

We use this information to open and maintain a record of your relationship with us, communicate with you for internal business purposes or emergencies, maintain an internal directory and grant you access to internal systems.

Job-related information and qualifications: such as previous job roles, education, awards, qualifications, certificates, licenses, financial relationships, compensation and salary information, and any other information you choose to provide to Cerner, for instance in your resume, RFP response or curriculum vitae.

We use this information to assess your suitability to provide services, conflict of interest reporting, and to fulfill our obligations to regulators (including demonstrating the suitability of contractors to provide services).

Emergency contact information: such as names, addresses, phone numbers and email addresses of your emergency contacts.

We use this information to contact the designated contacts in the case of an emergency, as appropriate.

Financial Information: such as your bank account details and tax information.

We use this information to pay you, provide tax forms or process any expense claims.

Travel-related records: such as frequent flyer numbers, itineraries, flight, train, rental car, car service, hotel or other similar information.

We use this information to arrange or reimburse travel, contact you during travel, as necessary with travel service providers, or in an emergency situation.

Compensation information: such as contracted service rates and other compensation-related information.

We use this information to process payments for services provided and other amounts we owe you.

Capability and conduct records: such as details of warnings and other records relating to conduct.

We use this information for assessing and taking action in relation to capability and conduct issues, maintaining your contractor records, monitoring and improving our contingent workforce procedures and processing and fulfilling our obligations to regulators.

Information we obtain from monitoring: such as records of your use of our computer systems or the Internet, and recordings from surveillance cameras on our business premises.

We use this to monitor your compliance with our internal policies and procedures, to investigate security breaches and misuse of computer equipment and systems, to protect the safety of associates, clients and third parties, and to protect our property from theft, vandalism and damage.

Demographic information: such as your ethnicity, religion, gender and sexual orientation.

We use this to conduct equal opportunity and diversity reporting where permitted or required by law.

Any other information that you store on our equipment and computer systems, such as electronic communications or documents that you create or upload to our systems.

We use this to monitor compliance with our internal rules and policies, investigate security breaches and misuse of computer equipment and systems, and in connection with our back-up and disaster recovery plans.


Cerner adheres to all state, federal and country-specific data regulations as it relates to the retention of personal information of independent contractors.


Additional Purposes for Using Personal Information

In addition to the uses set forth above, Cerner may use and share the categories of personal information identified:

  • To comply with applicable legal and regulatory requests and obligations (including investigations);
  • To establish or defend legal claims and allegations;
  • For security or the prevention, detection, or investigation of fraud, suspected or actual illegal activity, violations of company policy or rules, or other misconduct; or
  • To seek advice from lawyers, auditors and other professional advisers.
